The Skilled Worker Visa was implemented on January 1st, 2021, as part of a comprehensive immigration system reform that followed the United Kingdom’s departure from the European Union and the conclusion of the transitional period. This particular pathway is tailored to foreign skilled workers who are sought after to occupy a long-term position and address specific job vacancies.
The Skilled Worker Visa necessitates that the migrant fulfills the following mandatory criteria:
- Possess sponsorship from an organization that holds a Sponsor Licence (20 points)
- Exhibit a skill level at RFQ3 or higher (equivalent to A level) (20 points)
- Demonstrate proficiency in the English language at a B1 CEFR level (10 points)
In addition to the aforementioned points, an additional 20 points are required to meet the minimum threshold of 70 points. These remaining points can be obtained through either the individual’s salary or a relevant PhD qualification. These additional points are referred to as tradeable points.
In order to be eligible for a Skilled Worker Visa, it is necessary to secure sponsorship from a UK organization holding a Sponsor Licence.
Any organization based in the UK that can establish itself as a dependable entity, capable of fulfilling its Sponsor Duties, and can provide evidence of a genuine requirement for a sponsor licence, has the opportunity to become a Sponsor. If the organization does not already possess a Sponsor Licence, it will be required to apply for and obtain one before being able to sponsor a migrant.
The application process for the Skilled Worker visa is conducted online. As part of this process, the UK-based sponsoring organization is responsible for issuing a Certificate of Sponsorship (CoS). The CoS is an electronic document that contains essential information about the sponsoring organization, the migrant applicant, and the job itself. This includes details such as the job description and the salary associated with the position.
Skilled worker visas have the potential to be extended if the criteria for extension are satisfied.
The requirements for extension generally mirror those for entry clearance or initial leave to remain, including:
- Having a UK-based sponsor who is willing to issue a Certificate of Sponsorship (CoS)
- Ongoing fulfillment of the salary requirement, with any necessary adjustments made to meet the appropriate rate
- Continuation of meeting the maintenance requirements
- Meeting the English language requirement
- Maintaining compliance with immigration laws and possessing no recent criminal record
- Ensuring the job remains a genuine position and the migrant maintains the necessary skill level.
